CONTACT THROUGH SOCIAL PLATFORMS

Purpose of data processingThe Data Controller operates business Facebook (Jobtain / Jobtain – Transylvania / Jobtain – Ukraine official Facebook pages), LinkedIN and Instagram pages for the purpose of providing online contact, posting, recruitment, organizing events. In the process of posting comments to each post, the data controller gets to know the surname and first name of the commenters and their comments, which are accessed on the basis of consent. In the imprint of the Facebook pages (Bookmark/Imprint) and in the description of the Instagram and LinkedIN pages, there is a direct, clickable link to this notice. Messaging is also possible on the Social platforms. When sending a message, the Data Controller obtains the sender’s first and last name, which it obtains on the basis of the sender’s consent. In the case of contact by Facebook message, the Data Controller will inform the Data Subject in writing of the contact details of this notice and will inform the sender that the Data Controller will only process his/her personal data if the sender confirms in writing that he/she has read and accepted the contents of this notice. Both posts and messages will be stored electronically on the server of the Social platform concerned, until deleted.
Duration of data processingThe personal data provided in the message will be processed for a maximum of 3 working days in the absence of written consent and for a maximum of 36 months if consent is given.

If the voluntary written consent form is not available to our Company after the 3rd business day, we will delete all of the Data Subject’s personal data from our database. Visitors are subject to Facebook’s Privacy and Terms of Service. In the event of publication of illegal or offensive content, the Data Controller may exclude the Data Subject from membership or delete their posts without prior notice.

During the job application process, the personal data provided by the Data Subject is entered into the Company’s password-protected, cloud-based database (HR software) in order to enable the Company to contact the Data Subject with job opportunities that match their qualifications and competencies.

Our Company, in order to assist the Data Subject in obtaining employment and being present on the labor market as effectively as possible, carries out recruitment activities on behalf of employers/advertisers according to their specified preferences. In this context, it conducts filtering activities in the database for specific job opportunities.

Objective: – to find and offer the most suitable job opportunities for the establishment of an employment relationship for natural persons based on their qualifications, abilities, and needs, – to establish a connection between the natural person and the organization seeking workforce, and to conduct selection procedures, – to support the creation and/or maintenance of employment relationships for natural persons (employment mediation), – to create and maintain employment relationships aimed at temporary staffing. Not all of the listed data is necessarily requested, but there are some data that are indispensable for assessing the suitability for the position and are absolutely necessary for the Company to proceed with the establishment of the employment relationship. Our Company does not wish to handle special personal data disclosed without explicit request (e.g., data contained in a CV, or communicated through recorded lines, Messenger, Facebook, or email), therefore we ask that you do not provide such data in the absence of an explicit request. Your data will not be used for purposes other than those specified.

Purpose of data processing

– The forwarding of the User’s application to the employer/advertiser;

– Searching and filtering by the Company among the Data Subjects according to the preferences specified by the employers/advertisers;

– By applying for the job advertisement, the Data Subject consents to the transfer of their data to the employer/advertiser, as well as the recording of their data necessary for the job application in the Company’s database (HR software system).

Duration of data processingThe Company retains and manages the data of the specific job application in its database for up to 36 months or until you withdraw your consent. After 36 months, the data is automatically deleted. If during the 36 months the Data Subject provides a new consent statement to our Company, the data processing period will be calculated from the date of the new statement.

DATA PROCESSING RELATED TO EMPLOYMENT

The scope of personal data involved, the purpose of data processing, the legal basis for data processing, and the duration of data processing are detailed in Annex 1 of the privacy notice.

– ensuring the conditions related to the establishment of employment and maintaining contact, as well as

– exercising rights and fulfilling obligations arising from the employment relationship between the Data Subject and the Data Controller, in accordance with the provisions of the employment contract and the Labor Code regarding the performance and termination of the employment relationship.

The method of data processing: paper-based and electronic

Our Company only makes copies of documents whose registration is justified by legal obligations. In other cases, our Company only requests documents for inspection purposes and only for presentation from the data subjects.

Duration of data processingOur Company stores and manages part of the Data Subject’s personal data (name, place of birth, date of birth, gender, mother’s name, address, ID number, tax identification number, social security number, highest educational qualification document identifier) for the period specified by applicable labor laws, and presents them to the employment supervisory authority in case of an inspection. We manage the Data Subject’s other data for up to 36 months from the date of voluntary written consent or until the consent is withdrawn..

Our Company processes the special data (e.g., health-related information) provided by the employee for the purpose of protecting the employee’s interests and fulfilling legal obligations related to the establishment and maintenance of the employment relationship, as well as other legal obligations.

Our Company does not process special data disclosed without explicit request; therefore, we ask that you do not provide such data in the absence of an explicit request.

The Data Controller processes special data only if one of the conditions specified in Article 9(2) of the GDPR is met.

Jobtain HR Szolgáltató Kft. may process your special health data in connection with the prevention of the pandemic related to the state of emergency in the country, or the mitigation of its consequences, to protect your health and life.

By accepting this statement, you declare that you have received:

– the information that the processing of your health data specified in Annex 1 is necessary for the establishment of your employment relationship.

– the information that the consent given for the processing of your health data can be withdrawn at any time, but in case of withdrawal, your employment relationship may be terminated

When can you request the deletion or correction of your data?

Our Company will promptly correct any data we manage that does not reflect reality at your request and will complete any incomplete data. We will notify you of the correction and deletion by email in every case.

When can you request information about the processing of your data?

You can request information about the processing of your personal data at any time (exercise your right of access). Upon your request, our Company will provide information about the personal data we process, who processes the data, and for what purposes. Information can be requested via email at adatvedelem@jobtain.hu.

During the transfer of data, we pay special attention to data security, adhering to the strict requirements of the GDPR and taking all necessary measures to prevent unauthorized access.

In the case of candidates and employees from third countries (non-EEA countries), it may occur that the level of data protection regulation in the third country to which the personal data is transferred is lower than that of the European Union, and the third country may not ensure an adequate level of protection.

According to Article 49(1) of the GDPR, in the absence of an adequacy decision under Article 45(3) or appropriate safeguards under Article 46 – including binding corporate rules – the transfer or multiple transfers of personal data to a third country or international organization can only occur if at least one of the conditions specified therein is met. According to point (a) of this Article, data transfer can also take place if the data subject has explicitly consented to the proposed transfer after being informed of the potential risks of such transfers due to the absence of an adequacy decision and appropriate safeguards.

In the absence of appropriate safeguards, the risks arising from data transfer may include that you cannot be sure whether the rights you are entitled to under the GDPR, as outlined in Chapter „K”, will be enforceable.

For example, in the case of transferring your data to a third country, it is not certain that there is a supervisory authority or data protection officer in the third country. Although you may be able to appeal to a court, entirely different rules may apply to the processing of your data, etc.

  • Until the conclusion of the contract or the unsuccessful termination of negotiations
  • In the case of successful negotiations or contract conclusion, for the duration of the underlying contract, but if the personal data also appears in the contract and/or invoice, then 8 years based on the Accounting Act.

If the contact person’s employment/engagement with our business partner terminates and this is communicated to us in writing by the partner or the contact person, their data will be deleted within 30 days of receipt.

Thus, images and videos specifically created for this purpose may be published and communicated to the public on our Company’s own websites, other web platforms, online media, social media platforms (Facebook, LinkedIn, Instagram, TikTok, YouTube, etc.), as well as in printed media, advertising materials, and brochures.

We will provide detailed information to the Data Subjects about the handling and publication of recordings considered as mass recordings taken at our events in the event description. In other cases, we will ask the Data Subjects for separate written consent for the creation, publication, and handling of images.

We would like to inform you that you have the right to withdraw your consent to the publication of the recordings. In this case, the Data Controller has the right to use the image and video recordings further only if another legal basis allows it.

Please note that there is no camera surveillance at the Data Controller’s headquarters and branch offices. Our Partners are required to appropriately inform Data Subjects about camera surveillance at their own headquarters and branch offices.

If a significant incident (e.g., vandalism) occurs at the aforementioned locations and the affected Partner provides the video recordings as evidence to the Data Controller, Jobtain HR Szolgáltató Kft. has a legitimate interest in processing the provided recordings in accordance with GDPR provisions.

SECURE DATA STORAGE

Our Company takes all reasonably expected technical and organizational measures to protect your personal data, including against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. For paper-based data storage, we use locked storage; for electronic data processing, we use password protection, assignment of access rights, encryption for data transmission, and physical and software protection of IT and communication devices to ensure the secure handling and storage of data.

Who is authorized to process my data?

The processing of data is carried out exclusively by our Company’s authorized employees in the course of their duties. Only designated employees are authorized to access the stored data. The scope of authorized personnel is detailed in sections C.1 and C.2 of our Privacy Policy and in Annex 1.

To protect the data, our Company instructs all individuals authorized to process data to comply with the provisions of this notice and the relevant laws, and they are also bound by confidentiality obligations.

What should I do if I become aware that unauthorized persons have accessed my personal data?

If you notice any problems related to the processing of your personal data or become aware that unauthorized persons have accessed your data, you can report it to our Company using the Data Protection Incident Reporting form available on our website. The system will automatically notify the responsible colleague, who will take the appropriate steps and notify the authorities in accordance with the regulations and within the required timeframe if the conditions are met. Following the investigation, based on its outcome, we will inform the affected parties by email with the required level of detail.

Right to Request Information

You can request information about the processing of your personal data at any time. Upon your request, our Company will provide information about the personal data we process. Right of Withdrawal

You can withdraw your previously given voluntary consent to data processing at any time. You can request the withdrawal of your consent via the email address adatvedelem@jobtain.hu, through our central customer service number +36-30/974-60-35, or by post (Jobtain HR Szolgáltató Kft, 1094 Budapest, Tűzoltó utca 72. ground floor Ü-1). Please note the conditions mentioned at the end of section 2 (termination of employment) when exercising this right.

Right of Access

You can receive confirmation from our Company at any time as to whether your personal data is being processed, and if such processing is taking place, you are entitled to access your personal data and the following information:

  • the purposes of the data processing;
  • the categories of personal data concerned;
  • the recipients or categories of recipients to whom the personal data has been or will be disclosed;
  • the planned duration of personal data storage;
  • your right to request rectification, erasure, or restriction of processing of your personal data and to object to such processing;
  • the right to lodge a complaint with a supervisory authority;
  • information about the data sources if the personal data was not collected from you;
  • the existence of automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and the expected consequences of such processing for you;
  • if personal data is transferred to a third country, you have the right to be informed about the appropriate safeguards pursuant to Article 46 of the GDPR.

The requested information will be provided within a maximum of one month from the submission of the request through a channel or on a data carrier that is also suitable for you.

Right to Rectification

Our Company will correct any inaccurate data we process upon your request and complete any incomplete data. We will notify you by email in every case about the correction and deletion. Right to Erasure

You have the right to request the erasure of your personal data at any time, and our Company is obliged to erase your personal data without undue delay if:

  • the personal data is no longer necessary for the purposes for which it was collected or otherwise processed,
  • you withdraw your previously given consent, and there is no other legal basis for the processing,
  • you object to the processing and there are no overriding legitimate grounds for the processing,
  • the personal data has been processed unlawfully,
  • the personal data must be erased to comply with a legal obligation in Union or Member State law to which the data controller is subject,
  • 3 years have elapsed since the acceptance of the data protection statement (consent).

The above provisions do not apply if the processing of personal data is necessary for:

  • Exercising the right of freedom of expression and information;
  • Compliance with a legal obligation which requires processing by Union or Member State law to which the controller is subject;
  • Public interest in the area of public health;
  • Archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes;
  • The establishment, exercise, or defense of legal claims.

Right to Object

You have the right to object at any time to the processing of your personal data for the purposes of the legitimate interests of the data controller or a third party, including profiling based on those interests, on grounds relating to your particular situation.

Taking Legal Action
